Two Months House Arrest for Homicide?
Remorseful minister to be confined for traffic fatality
FAIRBANKS CRASH: He could serve his sentence at his home. The Associated Press (04/10/11 22:37:00) FAIRBANKS -- A minister who killed a motorcyclist in a Fairbanks traffic crash last year has been sentenced to two months confinement, possibly in his own home. Anthony W. Buie, 59, had pleaded no contest to the charge of criminally negligent homicide for causing the death of 37-year-old Thomas N. Favero III on July 4. Prosecutors said Buie ran a red light in front of Favero on Cowles Street at Airport Way, a busy intersection near the community's library. Buie is a minister at True Victory Baptist Church in North Pole. Buie will serve his confinement at home using an electronic ankle bracelet if the Department of Corrections approves him for electronic monitoring. At sentencing Thursday, Superior Court Judge Michael McConahy said he was able to give a sentence outside the presumptive range of one to three years because Buie was found to have done everything he could to compensate the family of the victim. Prosecutors asked for a sentence of six months to send a strong message about the dangers of not paying attention when driving. Buie had a history of driving offenses, including a 21-year-old arrest for driving under the influence of alcohol or drugs. Defense attorney James Hackett asked that Buie not be given any driving restrictions that would interfere with his work as a minister. Buie is an excellent candidate for rehabilitation because he has shown remorse for his actions, Hackett said. The victim's wife submitted a letter supporting Buie that did not ask for any jail time. These comments from the article tell what the majority of us think of this sentencing! WOW. I guess being a Baptist minister isn't just about getting your tax exemption anymore. Hope Prevo doesn't feel empowered to start running over gay people in Anchorage... Good to know murder is ok in AK as long as you work for a church and seem to show remorse after you were caught murdering someone. 2 months house arrest is DISGUSTING. I'm not sure I understand the logic behind this extremely lenient sentence. Aw gee...slap on the wrist I'm going to stash a nun's habit in my car from now on in case I hit somebody. This story doesn't give all the inside details of what Rev. Buie has done to atone. If the victims wife is satisfied and the judge agrees who am I to disagree? AbdulKareemaWheat Courts issue punishment to both meet the letter of the law, and to satisfy society--that would be us--that laws are being enforced. It matters not what a victim's wife, son, daughter or postman thinks the sentence should be. What if they'd called for Mr. Buie to serve 45-50 years at Lemon Creek? That blindfold on the statue holding the scales of justice is there for more than a symbolic reason. subaruguy he's not the only one getting house Arrest in Fairbanks for killing someone. Freddy from Airport Rentals is getting off the same way for killing that little girl on the Steese last summer. They are moving his family out of state, to Florida so he can ride out his house arrest. Amazing you can outright kill someone with a vehicle and get away with it now a days... Lesson learned is if you drink and drive and take a life, just act like you feel bad for doing it. According to the judge, he can suspend the laws of our country for this "man of god." Why do clergy get different treatment under the law? If he was truly sorry he can get a lighter sentence UNDER THE SENTENCING GUIDELINES! The judge is overstepping his constitutional role here by making his own laws. We need more details about this case. Should christian judges be removed from cases where they have a conflict of interest over the crimes of clergy? Will the D.A. let the judge get away with this? Minister or not the entire concept of personal responsibility is dead and gone in America.The lightweight currently serving as President is proof of where priorities are for at least half this fucked up Country.

I got excited when I say the title. I started making my list.
Crimes like this are tough, and I wouldn't want to be a judge. On one hand, it was not with malice, but on the other hand lack of responsibility and endangering others, does become malice. It was an accident, but someone is dead now. A 21 year old drunk driving doesn't really show a history to me.

Did some checking,found that the identity of the victim plays an important part in sentencing length.Longer sentences are given to offenders when the victim's female….FWIW here we have the victim's wife writing a supportive letter on behalf of the Minister.
Also found that all states except Alaska, Montana, and Arizona have vehicular homicide statutes. His showing remorse mean nothing to me,probably was sincere but anyone in this Minister's shoes would be stupid not to get an attorney immediately and any attorney with half a brain's gonna tell ya the proper pre-trial hoops to jump through.
